It’s Cheaper to Retain An Attorney: You Wasted Money

Q.

Hello Mr. Famuyide:

This is my immigration situation.  I would like your input in this matter.  I am originally from Trinidad and Tobago.  My adjustment of status was denied last year.   My aunt, a US citizen filed for my father, mother, brother and me in April 2001 (LIFE ACT).  We were approved in April 2005. My brother was twenty years old in 2001 and I was 23.   We were able to file for adjustment of status on September 2010.  We were given appointments for fingerprinting and given alien numbers and medical requirements.   The Immigration...

You Cannot Petition for your Grandmother

grandmother

Q.

Hello my name is T.  I have a question in regards to filing a lawful permanent resident petition.  I am a U.S citizen who wants to file for my grandmother.  She has been living in the U.S for over 10 years and came on a visa and hasn’t received her green card yet.  I will like to know if it is possible for me to file for her since I am a U.S citizen.  My mother is a lawful permanent resident in the U.S with her green card but she doesn’t know if she can file for her since she isn’t a U.S citizen.  My father is my grandmother’s son-in-law and he is a U.S citizen.  Can either parent or myself file for my grandmother?  What can we do at this moment to help my grandmother become a permanent resident?  Thank you for your time and consideration.

Your Situation is Better Than That of Many

Q.

Hello Mr. Famuyide,

I have been subjected to a similar situation as described in the case for CSS that lasted 20 years before it was finally settled. My situation is a little bit different as I went out of the country on parole and upon my arrival; I found that I had been deported due to revoked CSS cases in Feb. 1998. Not only that, I was also barred for 5 years from entering the U.S. illegally. Now I live in Canada as a Canadian citizen and visited US many times as the bar has been lifted and the waiver has been granted. Do you think I have a chance of getting green card? Please provide your thoughts. I greatly appreciate your time.

Marriage to U.S. Citizen will give you Green Card in 4 months.

Q.

Hello,

This is regarding my Employment Authorization Card.  It expired a few years ago and I never renewed it. I recently got married to a Green Card holder who has applied for Citizenship early this year.  My spouse's case is still pending with the USCIS.  Also we have a 4 month year old daughter who was born in the US last year.  My question is:  I don't know whether to renew my work permit and then apply through my wife for a Green Card or just apply directly through my wife for a Green Card without renewing my work permit.  It would be of uttermost importance that I will be able to make travel arrangements, especially abroad, in the not so distant future.  Please advise if you can help me in this type of situation.  Thank you very much...

Q.

Dear Attorney,

I received an e-mail from someone from the US Department of State who saying that I won DV lottery 2012. Luckily, I had read your article (DV lottery 2012 fraud) in your vol. 4 No 60 March 1, 2011 of the USI News. Your advice helped me to recognize that it was a fraud. When I checked the link of the DV lottery, I saw that I didn't win. The email asked for my postal address so they could mail the whole letter to me.

Thank You.
