And the winner is ……… The result of the first batch of the Diversity Visa Lottery for those who will be admitted into the United States as permanent resident aliens during the fiscal year starting from October 1, 2007 to September 30, 2008 was released on or about April 3, 2007. The result will continue to be released in batches until about July 2007.

The first caller with a thank you note to my office was from Atlanta, the second was from New Jersey and the third from Brooklyn, New York. After these initial calls we have received so many others to thank the Law Office of Joseph Famuyide for successful entries to the program filed on behalf of our clients in December 2006. We feel elated that our office continues to contribute in no small measure to helping people gain their permanent resident status in the United States. On behalf of USI News and the Law Office of Joseph Famuyide, I want to congratulate all winners of the DV Lottery 2008.

May I also add that, if our office helped you enter for the DV Lottery program last year and you have received the winning package, please call us or send us a note. Every year, winners from our efforts continue to increase. We are determined to continue to make a mark in the map of successful immigration attorneys in the United States. Congratulations!!!

Now that you have received the winning package, let me advise you on what you will need to do to translate the winner ticket to the much desired green card. As a note of warning, please be advised that the winning letter is sent to about 100,000 people yearly and only 55,000 people will actually receive permanent resident status. You must do all that is required to be part of the 55,000 so that the joy of winning is not cut short.

Winners outside the United States have two tactical advantages over those who are presently in the United States. First of all, winners outside the U.S. have no impediments to eligibility and secondly, they can begin the processing and submission of their forms immediately.

If you are in a winner in the United States, you are not required to submit the forms sent with the package except that you need to pay the fee and wait until after October 1, 2007 depending on your winning number. The pathway to reaping the proceeds of winning is complex and you will need to retain an attorney to assist you, otherwise you may receive a rejection letter when it is too late to rectify it.

If you are in the United States and you are out of status, you have a more difficult hurdle to cross. You are required to be in status at the time of filing the application for adjustment of status. There are two ways this problem could be solved. If you have a previous petition or a pending application for labor certification that was filed on or before April 30, 2001, you will be able to use such application to grandfather your DV Lottery application and obtain your permanent resident status by paying a penalty of $1000. In this case you will not need to depart the United States to obtain your resident status. The other alternative is if the law changes between now and October 2007 or if the S.245(i) relief which allows the payment of penalty for overstaying in the United States is reinstated, winners could take advantage of such.
